Frequently asked questions

Find answers to frequently asked questions about the practice, contact and legal procedures.

What are your practice areas?

The practice covers immigration law, administrative law, human rights, employment law, real estate and tenancy, and criminal law. Administrative work extends beyond immigration decisions. Alongside residence, citizenship and work permits, matters include employment and housing disputes affecting foreign nationals.

How can I get in touch?

You can use the telephone number or email address in the Contact section. A brief description of the issue and the stage of any existing application or proceedings is useful for initial contact. The scope and method of sharing detailed documents can then be clarified.

How can I challenge an administrative decision?

The appropriate route depends on the nature of the decision and applicable legislation. An application to the authority, an annulment action or a compensation claim may involve different requirements. The reasons for the decision, notification details and previous applications should be considered together.

How do Constitutional Court and ECtHR applications differ?

Türkiye’s Constitutional Court examines individual applications domestically; the ECtHR considers complaints under the European Convention on Human Rights internationally. Generally, ordinary remedies must be exhausted before the Constitutional Court and effective domestic remedies before the ECtHR. The necessary remedies and possible exceptions depend on the complaint.

Are residence permits and work permits the same?

A residence permit concerns permission to stay in Türkiye; a work permit concerns permission to work. A residence permit alone does not authorise employment. A work permit generally also serves as a residence permit, with exceptions for certain protection statuses. The individual’s status and intended work should be considered together.

Does marrying a Turkish citizen automatically confer citizenship?

Marriage to a Turkish citizen does not automatically confer Turkish citizenship. An application based on marriage is assessed against statutory requirements. Meeting the application requirements and acquiring citizenship are separate stages.

Are deportation and administrative detention the same measure?

A deportation decision concerns removal from Türkiye; administrative detention pending deportation concerns deprivation of liberty. These are separate decisions. Deportation decisions are challenged before an administrative court, while detention decisions are challenged before a criminal judgeship of peace.

Which languages can I use to communicate?

Communication is available directly in Turkish and English, and in French with interpreter support. You can indicate your preferred language when making initial contact.

How are employment matters affecting foreign nationals assessed?

Work permit procedures are considered alongside pay, working conditions, termination and social security. Contracts, payment and employment records, and permit and insurance status inform the assessment. Applicable rules are considered in light of the individual’s status, employment relationship and relevant international arrangements.

These answers provide general information. Remedies and conditions in an individual case require a separate assessment.
